These Terms & Conditions (“Terms”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and Brightworks-BG OOD (“Company,” “we,” “us,” or “our”), concerning your access to and use of the brightworksbg.com website (the “Site”) and any other related products or services that link or refer to these Terms (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the Services and must discontinue use immediately.

1. Our Services

7. Subscriptions

Your subscription will continue and automatically renew unless cancelled. You consent to us charging your payment method on a recurring basis without requiring your prior approval for each recurring charge. By posting your Contributions, you represent and warrant that you have all necessary rights or permissions to grant us the licence described above. We do not assert any ownership over your Contributions; rather, you retain full ownership of all of your Contributions and intellectual property rights.

12. Guidelines for Reviews

We may provide areas for you to leave reviews or ratings. When posting a review, you must comply with certain criteria, such as having firsthand experience, not posting offensive or discriminatory content, and refraining from false or misleading statements. We may accept, reject, or remove reviews at our discretion.

13. Social Media

You may link your account with third-party social networking accounts. By doing so, you authorise us to access certain account information and content in accordance with the third-party’s terms.

14. Third-Party Websites and Content

20. Governing Law

These Terms are governed by and interpreted according to the laws of Bulgaria, without regard to conflict of law principles. By using the Services, you consent to the jurisdiction of the courts in Sofia, Bulgaria.

21. Dispute Resolution

In case of a dispute, the Parties agree to first attempt to negotiate any dispute informally for at least thirty (30) days before initiating arbitration. Any dispute arising shall be determined by binding arbitration under the rules of the European Court of Arbitration, seat in Sofia, Bulgaria, in the English language.

22. Corrections

There may be information in the Services that contains typographical errors or inaccuracies. We reserve the right to correct any errors and to update the information on the Services at any time, without prior notice.

23. Disclaimer

The Services are provided on an “AS-IS” and “AS-AVAILABLE” basis. You agree that your use of the Services will be at your sole risk. To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the Services and your use thereof.

24. Limitations of Liability

These Terms constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision. If any provision is held invalid, the remainder of these Terms shall continue in full force and effect.
